Liability Waiver

1. ASSUMPTION OF RISK

I acknowledge that welding and related activities involve inherent risks, dangers, and hazards including but not limited to: burns from hot metal, sparks, and UV radiation; eye injury from arc flash; inhalation of fumes and gases; electric shock; cuts and abrasions from metal; hearing damage from noise; fire hazards; and other injuries that may result from the use of welding equipment, tools, and materials. I understand that these risks may result in serious bodily injury, disability, death, or property damage.

I VOLUNTARILY ASSUME ALL RISKS associated with my participation in the Activities, whether or not caused by the negligence of the Academy, and whether or not such risks are foreseeable.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by the laws of the State of Florida, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Academy, its owners, operators, instructors, employees, agents, affiliates, successors, and assigns from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in the Activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE ACADEMY OR OTHERWISE.

3. INDEMNIFICATION

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Academy from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of my involvement in the Activities, and to reimburse the Academy for any such expenses incurred.

4. MEDICAL ACKNOWLEDGMENT

I certify that I am physically fit and have no medical condition that would prevent my full participation in the Activities. I agree to inform the Academy of any medical conditions, allergies, or physical limitations prior to participation. I authorize the Academy to seek emergency medical treatment on my behalf if necessary, and I accept financial responsibility for any medical expenses incurred.

5. SAFETY RULES AND INSTRUCTIONS

I agree to follow all safety rules, instructions, and guidelines provided by the Academy and its instructors. I understand that failure to comply with safety protocols may result in immediate removal from the class without refund. I agree to wear all required personal protective equipment (PPE) at all times during the Activities.

6. PHOTO AND VIDEO RELEASE

I grant the Academy permission to use photographs, video recordings, and other media taken during the Activities for promotional, educational, and marketing purposes, including but not limited to use on the Academy's website, social media, and advertising materials. I waive any right to compensation for such use.

7. GOVERNING LAW AND JURISDICTION

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of or related to this Waiver or the Activities shall be resolved exclusively in the courts of the State of Florida.

8. SEVERABILITY

If any provision of this Waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

9. MINORS

If the Participant is under 18 years of age (minimum age 16), a parent or legal guardian must sign this Waiver on behalf of the minor. The parent or legal guardian agrees to all the terms and conditions herein and accepts full responsibility for the minor's participation in the Activities.

10. ACKNOWLEDGMENT

I have read this Waiver and Release of Liability in its entirety. I fully understand its terms and conditions. I understand that I am giving up substantial rights, including my right to sue. I sign this Waiver freely and voluntarily without any inducement or assurance of any nature.
